In general, tortious interference with prospective business relations is a tort that does not revolve around an existing contract. A contract is an agreement between two or more competent parties in which an offer is made and accepted, and each party benefits.

In general, tortious interference with prospective business relations is when there was a reasonable probability that a party would have entered into a business relationship with a third person but someone else intentionally interfered (conduct was independently tortious or unlawful) with the relationship causing a party injury.

In general terms, in order to sue for tortious interference with prospective business relations a party should be able to show (generally):

  • that there was a reasonable probability that a party would have entered into a business relationship with them
  • a third party intentionally interfered with the relationship
  • the third parties conduct was independently tortious or unlawful
