A premises liability claim is type of ordinary negligence claim brought by someone who claims to have been injured due to the condition on a property.

If you have been injured due to the ordinary negligence of another person or institution you deserve full compensation for the resulting injury and other expenses that you may be entitled to as a result of your premises liability claim.

Licensee

In Texas, a licensee is a person who enters the premises with the possessor's express or implied permission, but for only for the licensee's convenience or on business for someone other than the possessor.

Generally, the licensee is their only for his own purposes and not for any business dealing with the possessor.

In general, a premises liability claim by a licensee may include the following:

  • a licensee
  • on premises owned by someone else - possessor
  • a condition on the premises posed an unreasonable risk of harm
  • owner had actual knowledge of the danger on the premises
  • licensee did not have actual knowledge of the danger on the premises
  • premises owner (possessor) breached a duty of care by failing to adequately warn of the condition and failing to make the condition reasonably safe
  • this breach caused the injury to the licensee
