A premises liability claim is type of ordinary negligence claim brought by someone who claims to have been injured due to the condition on a property.

If you have been injured due to the ordinary negligence of another person or institution you deserve full compensation for the resulting injury and other expenses that you may be entitled to as a result of your premises liability claim.

Invitee

In Texas, an invitee is a person who enters the premises with the possessor's express or implied knowledge and for the parties' mutual benefit.

Some jurisdictions define an invitee as either be a public invitee or a business visitor and some look to determine if the possessor of premises had knowledge of invitee's entry onto the premises and if it was for their mutual benefit.

In general, a premises liability claim by an invitee may include the following:

  • an invitee
  • on premises owned by someone else - possessor
  • a condition on the premises posed an unreasonable risk
  • owner knew or reasonably should have known of the danger on the premises
  • premises owner (possessor) breached a duty of care by failing to adequately warn of the condition and failing to make the condition reasonably safe
  • this breach caused the injury to the invitee
